General conditions of sale and use of the site
1. OBJET
TELEMAQUE proposes a service of personalized astrological studies through remote sale, on line consults of horoscopes and astrology and tarology and numerology and divinatory arts, (hereafter collectively named the “Products”), that can be accessed through URL: http://www.astro.fr, (indicated hereafter as the “Web site”). The order on line of Products TELEMAQUE implies the general acceptance by the customer (indicated hereafter by the “Customer”) of these General Sale Conditions, which he would have taken into consideration beforehand. Special additional conditions can complete the present General Sale Conditions. The Customer will be informed via the Web site before any transaction.

2. CONDITIONS REQUIRED TO PLACE ORDER
To place orders on the Website, the Customer must be at least 18 years, have legal capacity and use the Website in accordance with these terms and conditions.
The Client also guarantees the veracity and the exactitude of information which it provides.

APPLICABLE DUTY
The parts are appropriate that the contract concluded with the Customer is subjected to the French right.
4. STAGES OF THE ORDER
The ordering process online include at least the following steps: - The customers selects the product of their choice; - A description of the Product and its cost is posted; -The Customer is invited to accept the present General Conditions of Sale by notching the box envisaged to this end; - Customer chooses its mode of payment; - The customer is invited to provide contact information unless he chooses a payment method preserving his anonymity. All data binding is indicated by an asterisk; - After payment, the Customer reaches the Product.
5. VALIDATION OF THE ORDER
The order placed by Customer will be regarded as effective only when the centres of banking payment concerned give their agreement on the transaction considered. In case of such refusal, the order will automatically be cancelled.
6. ACKNOWLEDGMENT RECEIPT OF ORDER
The Customer will be able to obtain and reach essential information on its controls, while addressing itself to TELEMAQUE with the following address e-mail: chat-admin@chat.telemaque.fr. The Customer will have to provide to TELEMAQUE personal information which is necessary for him to identify the orders placed by the Customer. For the orders having been made in an anonymous way, the Customer may obtain and reach essential information relating to his orders while addressing providers in which payment was made anonymously.

TARIFFS AND PAYMENT
Product prices are quoted in Euro inclusive of VAT
Any change in VAT rates will be automatically reflected on the price of the Products.

In a general way, the modes of payment which can be used are the payment by credit card, the accepted credit cards being mentioned on the Web site, the payment by SMS, the payment by taken down telephone, the payment by Ticket Surfing, the payment on France Telecom invoice, the payment on the invoice of the subscription with the Internet.

SAFETY OF THE TRANSACTIONS

9.CAUSE BEYOND CONTROL
TELEMAQUE releases any responsibility for an unspecified failure with its contractual obligations on the assumption for a cause beyond control or fortuitous, y included/understood, but without there being limited, war, catastrophes, fires, internal or external strike, failure or breakdowns internal or external, and in a general way any event not allowing the good execution of the orders. TELEMAQUE could not be held responsible for the problems being occurred at the time of the protected transactions. This responsibility falls on the various organizations ensuring these services.

EXCLUSION OF THE RIGHT OF RETURN
Conformément à l'article L.121-20-2 du code de la consommation, le Client est informé que le droit de rétractation ne peut pas être exercé pour les contrats de fourniture de services dont l'exécution a commencé avant la fin du délai de sept jours francs. In accordance with the Article L.121-20-2 of the Consumer consumption, the Customer is informed that the right of withdrawal cannot be exerted for the supply agreements of services whose execution started before the end of the period seven days frank.

CONFIDENTIALITY AND PROTECTION OF PERSONAL DATA
The information that the client communicates on the Website allows TELEMAQUE process and executes commands.
In accordance with article 32 of the Data-processing Law and Freedoms of 1978 January 6th, essential information for TELEMAQUE to treat and carry out the orders, are announced by an asterisk in the pages of the Web site. Other required information, for which the answer is optional, is intended for better knowing the Customer as to improve the Products which are offered to him.
The personal data processing of the Customer is done by TELEMAQUE, which is committed ensuring a sufficient level of protection of information provided to guarantee the respect of the private life and freedoms and basic rights of the people.
The Customer is informed that its banking data will be preserved throughout one 180 day necessary to the fight against the payment fraud. The banking data are encrypted and stringent security measures are taken. In accordance with the Data-processing Law and Freedoms, the Customer has a right to access, modify and delete data which relate to it (articles 38 to 40 of the Data-processing Law and Freedoms of January 6, 1978).
The Customer will be able to be opposed to the processing of his personal data only for legitimate reasons. Except opposition on behalf of the Customer, TELEMAQUE and his partners are likely to communicate to him, by mail and/or email and/or telephone, for offers of Products and services, for messages with advertising aiming and information on the Products and services proposed by TELEMAQUE and its partners.
12. PROTECTION FOR INTELLECTUAL PROPERTY
All the contents of the Web site and all intellectual property rights relating to it is the property of TELEMAQUE and, if necessary, the company publishing the site.It is conceded with the Customer no right to the contents and intellectual property rights of ownership intellectual of the Web site. Any implementation of hypertext links to the Website shall be subject to prior written agreement and written form TELEMAQUE. Any unauthorized use of all or part of the contents of the Website exploitation and rights of ownership intellectual relating to it, could be the subject of legal proceedings.
13. USE OF THE WEBSITE

TELEMAQUE is not responsible if the Customer cannot access the Website, due to a particular of maintenance actions or if the access is stopped, at any time that it is, or if any defect, independent of its will, prevents from carrying out an operation.
14. INSTALLATION OF A COOKIE
Definition of a cookie: includes information relating to the navigation of a visitor. TELEMAQUE wishes create a cookie in the computer’s Customer. A cookie does not make it possible TELEMAQUE to identify the Customer; but, it records information relating to the navigation of the computer of the Customer on his Web site (pages that the Customer consulted, the date and the time consulting, etc) The shelf life of such information in the customer's computer is 10 years.
